BlackMilk Loyalty Program Terms & Conditions

Welcome to the BlackMilk (“The Company”) Sharkie Arcade Loyalty Program ("The Program"),  where boldness is rewarded, loyalty is legendary, and shopping is anything but boring. These Terms & Conditions ("Terms") govern your participation in the Program. By joining or participating, you agree to be bound by them, so read on, Sharkie (“Customer”).

1. Program Eligibility

1.1 You must be at least 18 years old to join the Program. By signing up, you confirm that you are a legal adult capable of entering into binding agreements.

1.2 The Program is available to customers in countries and territories where participation is permitted by law and where BlackMilk is able to offer its services. BlackMilk reserves the right to restrict or withdraw availability in any region at its discretion.

1.3 Each customer may only use one email address to participate in the Program and must be signed in with that email address to be eligible for any Token accrual and Program benefits.

1.3.1 Accounts, Tokens, and Tiers cannot be merged across multiple accounts.  

1.3.2 Any additional or duplicate accounts may be restricted from participation, unless otherwise approved at BlackMilk’s discretion. 

1.3.3 BlackMilk reserves the right to identify and consolidate or remove accounts that appear to belong to the same individual where multiple accounts have been created to obtain additional Tokens or benefits.

1.4 Customers may request to update the email address associated with their account; however, this will only be permitted where the new email address has no existing or prior account history within the Program.

1.4.1 BlackMilk reserves the right to approve or decline any email change request at its sole discretion, including where there is any risk of duplicate accounts, Token manipulation, or misuse of the Program.

1.5 Starting Your Token Balance 

1.5.1 Customers who have at least one eligible purchase (as defined by the exclusions below) before joining the Program, may enter the Program with a starting Token balance, calculated from their lifetime piece count (from first purchase through to last purchase prior to the date of entry).

i) Previous exclusions apply (including returns, items under $29.00 AUD, hosiery, and other excluded categories). 

ii) The total piece count is multiplied by an average piece value of $85.00 AUD per piece. This method applies to the calculation of starting Tokens only.

iii) All Tokens earned after the Program Launch Date will be based on actual spend value, Earning Actions outlined in clause 2.1, and any applicable promotional multipliers.

iv) These pre-accumulated Tokens determine your starting Tier in the Sharkie Arcade, and any benefits associated with that Tier apply from the Program Launch Date.

v) This calculation is fixed and will not be reviewed or recalculated by any other method.

vi) Any starting Token balance is calculated solely from the purchase history of the email used to join the Program. Purchase history from other email addresses will not be combined or transferred, unless those piece counts were already merged under a previous program.

1.6 Any Tokens granted at or following the commencement of the Program will be used to determine your Tier status only. If BlackMilk introduces a redemption component, Token balances will be reset for the purposes of the redemption component only.

1.6.1 Tokens do not expire or reset for the purpose of tier tracking, regardless of whether a redemption component is introduced, unless otherwise stated by BlackMilk.

2. Earning Tokens

2.1 Tokens are the Program currency used to determine your status within the Program.

2.1.1 You can earn Tokens only through the following qualifying actions:

2.1.2 Tokens are displayed as whole numbers only. In the event that Tokens earned from a purchase include a decimal value, the displayed Token balance will be rounded down to the nearest whole number. However, fractional Tokens are retained within the system and will accumulate over time. Once these fractional amounts reach a whole number, they will be reflected in your visible Token balance.

2.2 Earning Actions 

2.2.1 Reviews: To be eligible to earn Tokens, reviews must be legitimate and comply with this clause (2.2.1).  

i) Reviews must be submitted as a Verified Review on the BlackMilk website (via a link or while signed in), include a photo, and contain written feedback. Reviews submitted on third-party platforms are not eligible for Token earning, unless otherwise confirmed in writing.

ii) Any reviews that are not approved due to policy violations (see Terms of Service) or inappropriate content will be deemed ineligible for Tokens, or may have Tokens revoked if already issued. 

iii) To qualify for Tokens, review images must clearly show the garment being reviewed being worn and tried on. Unrelated images or images showing garments laid flat, in packaging, or otherwise not being worn may be removed and will not be eligible for Token rewards. Only approved review content will contribute towards Token generation.

2.2.2 Birthday Boost (and Vouchers): To be eligible for a Birthday Boost (and your Birthday Voucher), your date of birth must be added to your profile at least 5 days prior to your birthday. To avoid missing out, we recommend adding this when you sign up. 

i) Your birthday isn’t automatically imported from any other accounts or info we have for you, so be sure to add it when you sign up.

ii) Tokens are boosted by a multiplier of 1.5 when you spend your Birthday Voucher. 

iii) Birthday Vouchers are issued on the day of your birthday and are valid for 90 days from the issue date. The date of issue may vary slightly depending on your time zone.

iv) As always, Vouchers are never redeemable for cash. 

v) Vouchers (including expired Vouchers) cannot be extended. 

vi) Vouchers issued as part of the Program are promotional benefits and are not purchased Gift Cards/Vouchers. As such, they are not subject to statutory minimum expiry periods applicable to Gift Cards/Vouchers under Australian Consumer Law.

vii) This benefit isn’t retrospective, so if your birthday was before the program launched, a Voucher won’t be issued for that past birthday.

viii) These Vouchers are provided at BlackMilk’s discretion and may be amended, withdrawn, or revoked at any time, subject to applicable law.

2.2.3 Refer a Friend: Tokens earned from referrals are subject to validation and approval before they’re credited. 

i) Referred customers will receive a 10% off code for their first purchase, valid for 90 days from date of issue. Additional terms and conditions apply.

ii) Referral Tokens are awarded once the referred customer completes a purchase. If that purchase is refunded, any Tokens earned will be adjusted accordingly. 

iii) Referred customer details remain private; Sharkies generate a unique referral link, which validates the referral. 

iv) Sharkies who attempt to falsify or abuse the referral system may be removed from the program at BlackMilk's discretion.

2.2.4 Insert Token One-Time Booster: This Entry Tier Booster is a one-time Token bonus designed to help Sharkies who reside in the Insert Token Tier to level up within the Program.

i) This earning action is only available to the Insert Token Tier. 

ii) To qualify, Sharkies must place 3 or more orders within any 3-month rolling period, with a total spend of $500 AUD or more across those 3 orders.

iii) This earning action awards bonus Tokens, on top of the Tokens earned from the qualifying purchases.

iv) Once earned, Tokens are added to the account associated with the email address used to make the purchases.

v) If a qualifying purchase is refunded during the accrual period or after Tokens have been awarded, and this brings the total eligible orders below 3 (regardless of total spend), your progress will be adjusted, or the corresponding Tokens may be deducted accordingly.

vi) If an item from a qualifying order is returned or exchanged (including size exchanges where applicable), the One-Time Booster Card progress may be adjusted accordingly where the qualifying criteria are no longer met. BlackMilk is unable to manually reinstate, amend, or restore Punch Card progress impacted by returned or exchanged items.

vii) BlackMilk reserves the right to introduce, amend, or apply reset conditions, time limits, or alternative qualification mechanics to these earning actions at its discretion, with or without notice, subject to applicable law.

2.2.5 Punch Card: Punch Card Tokens are earned after placing 10 orders of $200.00 AUD or more. 

i) This earning action awards bonus Tokens, on top of the Tokens earned from the qualifying purchases and on top of any Tokens earned from the Insert Token One-Time Booster.

ii) Once earned, Tokens are added to the account associated with the email address used to make the purchase.

iii) If a qualifying purchase is refunded and this reduces the total number of eligible orders below 10, the awarded Punch Card Tokens will be deducted accordingly, rather than the progress being reset entirely.

iv) If a qualifying purchase is partially refunded and the minimum order value is still met, your progress and/or Tokens issued will remain intact.

v) If an item from a qualifying order is returned or exchanged (including size exchanges where applicable), Punch Card progress may be adjusted accordingly where the qualifying criteria are no longer met. BlackMilk is unable to manually reinstate, amend, or restore Punch Card progress impacted by returned or exchanged items.

vi) BlackMilk reserves the right to introduce, amend, or apply reset conditions, time limits, or alternative qualification mechanics to these earning actions at its discretion, with or without notice, subject to applicable law.

2.2.6 In-Person Event Purchases: For purchases made at eligible BlackMilk in-person events, customers must provide the email address linked to their Sharkie Arcade account at the time of purchase in order for Tokens and eligible Program benefits to be applied.

i) BlackMilk is unable to retrospectively apply Tokens, tier progression, discounts, vouchers or other Program benefits to in-person event purchases where the correct account email was not provided at the time of transaction.

ii) Eligibility of purchases and available Program benefits may vary depending on the event, location, licensing restrictions, technical limitations, or point-of-sale setup.

iii) BlackMilk reserves the right to exclude specific events, products, promotions or transactions from earning Tokens or participating in Sharkie Arcade benefits at any time.

2.3 Tokens earned from purchases or actions outlined in clause 2.1.1 will be applied immediately. 

2.3.1 Tokens are not earned on Gift Voucher purchases themselves, only on purchases made using a Gift Voucher.

2.3.2 Tokens are calculated based on total net product spend (excluding Gift Vouchers shipping,  tariffs, import charges, duties, taxes charged at destination, returns and discounts).

2.3.3 If a purchase or action is refunded, returned, cancelled, or otherwise reversed, the corresponding Tokens will be deducted from your balance.

2.3.4 Tokens are not transferable (unless approved under clause 1.3 and 1.4) and can never be redeemed for cash.

3. Tiered Perks & Benefits

3.1 Your Token balance and ongoing earning actions determine your current Tier status within the Program.

3.1.1 BlackMilk may adjust, amend, or remove Tiers, Tier thresholds, or Tier perks from time to time, and will aim to provide notice where possible.

3.1.2 Tier perks apply only after the purchase or action that moves you into that Tier has been completed. New Tier perks don’t apply to past orders. 

3.1.3 BlackMilk reserves the right to adjust your Tier at any time where refunds, cancellations, or reversals result in you no longer meeting the applicable Tier requirements.

3.1.4 The current levels and perks are as follows:

3.2 Tier perks are not retrospective and can only be accessed from the time you enter or reach the Tier, or when the relevant benefit is introduced.

3.3 Tier Perks 

3.3.1 Insert Token Welcome Perks: On entry into the Insert Token Tier, you’ll receive a one time 10% off code, plus 200 Tokens.  

i) As this tier has fewer ongoing benefits, it includes a set of unique one-time perks.

ii) These perks are available to customers who are in this Tier at the time of program launch, as well as those who enter the Tier after launch.

iii) The 10% off code is single-use per customer and is valid for 30 days from the date of issue. There is no minimum spend, and the discount applies to all items in the cart, excluding Vouchers, shipping, duties, import charges, tariffs and taxes.

3.3.2 Early Access: Early access, otherwise know as Purchase in Preview, gives you the ability to purchase during our collection preview window*, and is valid on BlackMilk's non-licensed collections and selected licensed collections, at the discretion of BlackMilk Clothing and/or the licensor.

i) Licensed collections included in Early Access may have some inventory held back for the official release day to meet contractual obligations.

ii) Purchasing during preview secures your item. Orders placed during this period will not be processed or shipped until after the official release date, and will then follow our standard processing timeframes.

iii) The Purchase in Preview window typically begins at 9:00am AEST on the Friday prior to a collection release and runs through to 7:00am AEST on the Tuesday of release. BlackMilk reserves the right to amend this window at its discretion, and without notice. 

iv) Purchase in Preview generally applies to our main collection drops only and may not be available for smaller capsule drops that are released from time to time. Any early access to these releases is at BlackMilk’s sole discretion, and will be communicated to you by email where applicable. 

v) Adding items to cart during Purchase in Preview does not reserve inventory. Products remain subject to availability until checkout is successfully completed.

vi) For clarity, access to the Purchase in Preview window and any associated “Day One” discounts are separate benefits and may be offered independently.

3.3.3 Day One Discounts:  Where applicable, Day One Discounts are available on the first day of Early Access. Discounts apply only to items within the preview category and exclude Vouchers, shipping, duties, import charges, tariffs and taxes.

i) The Day One Discounts window typically opens at 9:00 am AEST on the Friday prior to a collection release and closes at 11:59 pm AEST on the same day. BlackMilk reserves the right to amend this window at its discretion, and without notice. 

ii) Purchases made outside of this window will not be able to have the discount applied retroactively.

iii) Day One Discounts apply to BlackMilk’s non-licensed collections and selected licensed collections, at the discretion of BlackMilk Clothing and/or the licensor. 

iv) Day One Discounts generally apply to our main collection drops only and may not be available for smaller capsule drops that are released from time to time. Any Day One Discounts on these releases will be at BlackMilk’s sole discretion, and will be communicated to you by email where applicable. 

v) Day One Discounts cannot be used in conjunction with any other discount code.

3.3.4 Secret Promos: Secret Promos are promotional offers that may be made available to eligible Sharkies from time to time. Details, availability, eligibility criteria, and access conditions may vary between promotions.

i) You must be subscribed to email marketing to receive Secret Promo notifications and offers.

ii) No rain checks will be offered unless otherwise stated.

iii) Notifications are typically sent via email and prior to launch - timing may vary.

iv) Promo windows may be limited, so product or promotional availability is not guaranteed.

v) Each Secret Promo may have its own specific terms and conditions, which will be provided at the time of launch.

vi) BlackMilk reserves the right to conceptualise, schedule, and launch Secret Promos at its discretion, which includes providing Tier-exclusive offer variations.

3.3.5 Vault Unlocked Purchases: Vault Purchases provide eligible Sharkies with access to selected past styles, subject to availability.

i) Access to Vault Unlocked Purchases is available to High Score and Hall of Fame Tiers only.

ii) Items are available to shop as stock becomes available, and requests for specific products cannot be accommodated.

iii) Availability may vary by region or country.

iv) This benefit is limited to one (1) item per calendar year for High Score Tier customers, with the limit resetting on 1 January at 12:00am AEST.

v) For Hall of Fame Tier customers, it’s limited to one (1) item per quarter, with the reset occurring every 90 days from 1 April 2026 at 12:00am AEST.

vi) The limits apply to completed purchases and cannot be reset through cancellations, returns, or failed transactions.

vii) Vault access resets each period and does not stack or roll over. This means you can purchase one piece per period, and if you don’t use it, it expires and resets for the next cycle.

viii) On the rare occasion a customer purchases more than they are eligible for, the order will be placed on hold and they will be contacted by Customer Service to facilitate a manual adjustment.

ix) BlackMilk reserves the right to determine the availability, selection, and timing of Vault stock availability within the Program. 

3.3.6 Hall of Fame Voucher: Customers who reach the Hall of Fame Tier will receive a $500 AUD Voucher upon entry.

i) The voucher is valid for 12 months from the date of issue and can be used across multiple purchases until the full value has been redeemed, or until it expires, whichever comes first.

ii) No minimum spend applies.

iii) The voucher may be used across all collections, including Vault items.

iv) Vouchers issued as part of the Program are promotional benefits and are not purchased Gift Vouchers/Cards. As such, they are not subject to statutory minimum expiry periods applicable to Gift Vouchers/Cards under Australian Consumer Law.

v) These Vouchers are provided at BlackMilk’s discretion and may be amended, withdrawn, or revoked at any time, subject to applicable law.

vi) Vouchers are never redeemable for cash. 

vii) The Hall of Fame Voucher is issued once per customer account only, unless otherwise determined by BlackMilk at its discretion.

3.4 Tier perks may be adjusted or withdrawn at BlackMilk’s discretion. Where changes are made, BlackMilk will aim to provide a replacement benefit of similar value; however, the determination of equivalent value will be made at BlackMilk’s discretion.

3.5 While you can still access most Tier Perks without being subscribed to email marketing, you must be subscribed to receive related notifications and offers.

4. General Conditions

4.1 BlackMilk reserves the right to modify, suspend, or terminate the Program (including Tiers, perks, Token values, and earning or redemption methods) at any time, with or without notice. We will aim to provide notice where reasonably possible.

4.2 Misuse of the Program, fraudulent activity, or breach of these Terms may result in the forfeiture of Tokens, removal from the Program, and/or cancellation of rewards (where applicable).

4.3 Tokens and Tier statuses are promotional in nature and do not constitute legal property or a form of legal tender.

4.3.1 Tokens and Tier status are not retroactive, unless otherwise confirmed within these terms and conditions. 

4.4 If a purchase is cancelled, refunded, or reversed, any Tokens earned from that transaction will be deducted from your balance, and your Tier may be adjusted if you no longer meet the applicable Tier requirements.

4.5 Access to Program perks and benefits requires you to be logged into your registered account, using the correct program-nominated email address, at the time of use.

4.6 BlackMilk will determine when and how any updates, changes, or new features to the Program are introduced. There is no guarantee that any elements of a previous program, or its conclusion, will carry over or be recognised in the current Program.

4.7 All currency references are in AUD. Any currency conversions are the responsibility of the customer.

4.8 All time references are stated in AEST. Customers are responsible for accounting for any time zone differences.

4.9 BlackMilk reserves the right to correct any errors relating to Token balances, Tier assignments, Vouchers, discounts, referral tracking, or Program benefits arising from technical issues, system errors, delays, or administrative mistakes.

4.10 If a customer account is closed, deleted, banned, or otherwise restricted, any associated Tokens, Tier status, Vouchers, and Program benefits may be forfeited.

4.11 This program supersedes all previous Loyalty and Rewards programs and operates independently from them. All previous programs are now closed and separate from this initiative.

4.12 By participating in the Program, you agree to BlackMilk’s Website Terms of Service and Privacy Policy.
